These Website Terms and Conditions (“Terms and Conditions”) govern the ordering, purchase, access, and use of all digital publications, videos, memberships, and services offered on the Website.

These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your”, or “user”). Nothing in these Terms and Conditions is intended to unlawfully restrict, limit, or avoid any rights or obligations created in terms of the CPA or ECT Act. If there is any provision you do not understand, it is your responsibility to contact us at info@femagraphy.com before accepting these terms.

2. Age Restriction & Mature Content (Nudity Warning)

The Website displays and distributes premium, fine-art photographic portraiture and video content featuring the uncovered, raw, and authentic female human form (artistic nudity).

  • Minimum Age: You explicitly warrant and represent that you are 18 (eighteen) years of age or older and possess full legal capacity to enter into a binding contract.
  • Legal Consumption: By accessing this content, you warrant that viewing fine-art artistic nudity is entirely legal within your local country, state, or jurisdiction. If you are under 18, or if such content is prohibited in your area, you are strictly forbidden from registering an account or purchasing any materials from this Website.

3. Account Registration & Security

To purchase and access our digital publications, you must register a unique user account using a secure username and password.

  • Personal Use Only: Your account credentials are for your personal, non-commercial use only and must never be shared with any third party.
  • Liability for Account Actions: You are entirely liable for all actions, orders, and transactions processed under your username and password, whether authorized or unauthorized, unless you have notified us of a breach prior to the transaction taking place.

4. Conclusion of Sale & Digital Availability

  • Order Processing: Registered users may place orders for digital publications, video streaming packages, or memberships. Femagraphy reserves the right to accept or reject any order based on payment verification or system errors.
  • When the Sale is Final: Unlike physical retail, a contract of sale (“Sale”) comes into effect the exact moment your payment is cleared and confirmed, and your automated user membership profile is granted digital access to the purchased publications within your account dashboard.
  • No Re-sale: All digital publications are sold strictly for personal viewing. Purchasing materials for distribution, re-sale, mirroring, or public broadcasting is strictly prohibited.

5. Strict No-Refund & Store Credit Policy

Due to the digital nature of our goods (immediate delivery of digital books, media streaming, and membership wall permissions), all sales are final.

  • No Reversals or Cash Refunds: In terms of Section 42(2)(f) of the South African ECT Act, the standard electronic cooling-off period does not apply to digital content that is instantly supplied and cannot, by its very nature, be returned. Once access to a digital publication or video stream has been provisioned to your profile, you are not entitled to any cancellation, cash reversal, or refund.
  • Exceptional Circumstances (Store Credit Only): In the absolute and sole discretion of Femagraphy management, if a transactional anomaly occurs or an exception is mutually agreed upon in writing, any approved adjustment will be issued exclusively in the form of a Femagraphy Store Voucher/Credit. Under no circumstances will cash, fiat currency reversals, or cryptocurrency refunds be processed.
  • Subscriptions: No partial or full refunds will be issued for subscription terms or memberships once the billing period has commenced.

6. Secure Payments & Gateway Processing

We are committed to providing secure online payment spaces. All data transactions are protected using industry-standard encryption technology.

  • Approved Payment Methods: Payment can be made via authorized credit cards, debit cards, Instant EFT, or electronic bank transfers where supported by our checkout framework.
  • Cryptocurrency Gateway: We utilize Coinsbuy, a specialized, highly secure payment gateway designed for alternative and digital asset processing. 7. Access to Digital Content (Delivery)

  • No Physical Shipping: Femagraphy does not ship physical books, clothes, lingerie, or accessories.
  • Browser-Based Access: Delivery is fulfilled entirely through the Website interface. Upon a successful transaction, the material is bound to your account profile via WooCommerce Memberships. To view your purchase, you must log into your account dashboard and access the high-resolution files via our browser-based interactive reader.

8. Intellectual Property & Copyright Protection

  • Strict Prohibition: You do not acquire any ownership rights by purchasing a digital publication. You are strictly prohibited from copying, downloading, taking screenshots of, ripping, distributing, publishing, or sharing any imagery or video content on external forums, social media platforms, or filesharing networks.
  • Enforcement: Any unauthorized use or scraping of the Website Content constitutes copyright infringement and will result in the immediate termination of your membership account without a refund, permanent IP blacklisting, and legal action for financial damages.

9. Website Errors

While we take every precaution to ensure accuracy, technical glitches may occur. Should a digital product display an incorrect price or description due to an error, Femagraphy is not bound to honor transactions based on that error and reserves the right to cancel the order and return the correct store credit to your profile.

10. Gift Vouchers & Promotional Coupons

  • Gift Vouchers: Purchased digital gift vouchers are valid for 12 months from the date of issuance and cannot be redeemed for cash or transferred.
  • Promotional Coupons: Any promotional discount codes or percentage coupons are issued at our sole discretion, can only be used once per customer check-out, and cannot be applied retroactively to an existing order.

11. Disclaimers & Limitation of Liability
